The family of Christopher Capps, who was a member of the Oglala Sioux Tribe, is suing law enforcement in South Dakota for his death in May 2010.

Capps, 22, was shot and killed by a Pennington County Sheriff’s deputy after an altercation. State attorney general Marty Jackley said the shooting was justified but his family believes Capps was targeted because of his race.

“We believe Christopher Capps’ death was tragic and unnecessary,” Sarah Baron Houy, the family’s lawyer, told The Sioux Falls Argus Leader. “We respect law enforcement, but this was a case of excessive force.”

The lawsuit was filed in federal court in South Dakota.
