County agrees to hold off Cayuga Nation foreclosure proceedings
Wednesday, January 12, 2011
Seneca County in New York has agreed to hold off foreclosure proceedings against the
Cayuga Nation
.
The tribe and the county were due in court tomorrow to argue the case. But the county asked for a delay in light of the
U.S. Supreme Court
decision in
Madison County v. Oneida Indian Nation
.
At issue is $5,500 in property taxes that the county says the tribe owes. The tribe says it can't be sued due to its sovereign immunity.
The Supreme Court was going to consider a similar issue in a case involving the
Oneida Nation
. Instead, the justices earlier this week ordered the
2nd Circuit Court of Appeals
to reconsider the dispute because the tribe has waived its sovereign immunity.
The Cayuga Nation has not waived its immunity to foreclosure proceedings.
