Viejas Band garnishes per capita payout in child support case

The Viejas Band of Kumeyaay Indians in California passed a resolution in June to recognize child support orders on a case-by-case basis.

The resolution allowed the tribe to review a case involving Sonnie Brown, a tribal member. He was ordered to provide support to his ex-wife, who is not a tribal member, and their three children.

The tribe agreed to garnish Brown's per capita payment to honor a state court order. The first check came to $747 although it's likely to increase to about $4,000 a month, The North County Times reported.

"They are committed to doing what is right for the children and retaining tribal sovereignty," tribal spokesperson Robert Scheid told the paper.
