The 10th Circuit Court of
Appeals won't rehear the Osage Nation's reservation status case.
A three-judge panel in March ruled that an act of Congress diminished the reservation. The tribe asked for a rehearing but was denied on Tuesday.
"Am I shocked? Yes,” Chief Jim Gray told The Tulsa World. “Am I disappointed? You bet. But am I conceding? No, I’m not.”
Gray said the tribe is considering an appeal to the U.S. Supreme Court.
