A new box of evidence has delayed the federal court trial of a man accused of murdering American Indian Movement activist Anna Mae Pictou Aquash.
Police in Denver, Colorado, alerted federal prosecutors about the box last month. It contains about 800 pages of documents and 20 recording tapes.
"Some of the documents I had never seen before yesterday and some of the tapes I have never heard before yesterday," Dana Hanna, the defense attorney for Richard Marshall, said in a court filing, the Associated Press reported.
Marshall, a member of the Oglala Sioux Tribe, is now set to go to trial April 13. He is accused of murdering Aquash on the Pine Ridge Reservation in December 1975 although the case against him has suffered setbacks.
Marshall was originally indicted at the same time as John Graham but prosecutors withdrew the charges against Graham because he is not a member of a federally-recognized tribe.
Marshall's role in the crime is not as clear because another witness will apparently testify that it was Graham who pulled the trigger.
Graham is facing charges in state court in connection with Aquash's murder. South Dakota Attorney General Marty Jackley, who prosecuted the Aquash case when he served as U.S. Attorney, said elements of the crime took place in Rapid City, off the reservation.
