Aquash murder defendant seeks release until trial
A man accused of murdering American Indian Movement activist Anna Mae Pictou Aquash wants to be released from jail until the May 12 trial.

Richard Marshall, a member of the Oglala Sioux Tribe of South Dakota, is "a sober, respected member of the tribal community," his lawyer said in court papers quoted by the Associated Press. His release would be subject to numerous conditions, the lawyer said.

Marshall pleaded not guilty to murdering Aquash on the Pine Ridge Reservation in December 1975. Arlo Looking Cloud, another tribal member, is serving a life sentence for his role in the crime.

John Graham, a Native man from Canada, is also charged with Aquash's murder. He says he can't be tried in federal court because he is not an "Indian" under U.S. law.

Aquash was Mik'maq from Canada.
