Two members of the Mashpee Wampanoag
Tribe of Massachusetts are taking their land claim to the 2nd Circuit Court of Appeals.
Amelia Bingham and her son, Steven, sued the state and the town of Mashpee to recover ancestral land. A judge dismissed the suit, saying the Binghams lacked standing to sue on behalf of the original tribal owners of the land.
The judge also said the Binghams hadn't demonstrated they were descendants of the original landowners.
The Binghams submitted new information but the judge ruled against them for a second time in May.
The Binghams are appealing the ruling, but are only including the state as a defendant, The Cape Cod Times reported.
