One of the men accused of murdering American Indian Movement activist Anna Mae Pictou Aquash renewed a request for a separate trial.

Richard Marshall, a member of the Oglala Sioux Tribe, is charged with first-degree murder. Federal prosecutors say he killed Aquash on the Pine Ridge Reservation in December 1975.

Marshall was indicted at the same time as John Graham, a Native man from Canada. Both were due to go to trial on May 12 until legal issues derailed the case against Graham.

The 8th Circuit Court of Appeals has to resolve some key issues affecting Graham's status as an "Indian" under federal law. In the meantime, Marshall said he deserves a speedy trial.
