The operators of a hog farm in Charles Mix County, South Dakota, is not under jurisdiction of the Yankton Sioux Tribe, a federal judge ruled on Wednesday.
Tribal members sought to stop construction of the hog farm, saying it was within the boundaries of the reservation. But Judge Lawrence Piersol said the property wasn't Indian Country.
The reservation has been the subject of a long-running diminishment case. Late last year, Piersol issued a ruling that said what remained of the tribe's land base.
Longview Farm has been building the hog farm about two miles from the tribe's Head Start. The only way to reach the site is through a Bureau of Indian Affairs road.
