Lawyers behind failed BIA abuse case file new suit


A law firm whose $25 billion abuse suit against the Bureau of Indian Affairs was thrown out o court is helping another Indian man bring a case against the Mormon Church.

Herman & Mermelstein of Miami is part of a team working with Ferris Joseph. The Sioux man says he was abused by a missionary of the Church of Jesus Christ of Latter-Day Saints when he was 10 to 12 years old.

Joseph, now 51, said he had no memory of the abuse until October 2004. He came it came back to him as he was headed to church with his sister.

The lawsuit was filed in federal court. Joseph said he wants assistance from the church to get his life on track.

The BIA case involved abuse at government-run boarding schools. The judge in the case said it had to be pursued before the agency before going to court.
