The Eastern Shawnee Tribe of Oklahoma filed a response brief in support of its land claim in Ohio.
The tribe says the passage of time should not be an issue in the case. But the 2nd Circuit Court of Appeals, in a decision refused by the U.S. Supreme Court, dismissed a land claim because tribes waited too long to sue.
The tribe also says the state can't raise a sovereign immunity defense and said it hasn't been compensated for the lands at issue. The tribe claims 146 square miles in western Ohio, along with hunting and fishing rights.
The tribe wants to settle the case for gaming rights but state officials won't negotiate.
