Ohio attorney general Jim Petro filed a motion in federal court on Wednesday seeking to dismiss the Ottawa Tribe's fishing rights.
The tribe, based in Oklahoma, says the 1805 Treaty of Fort Industry reserves the right to fish on Lake Erie. The tribe says it owns part of Bass Island.
In the motion [PDF], Petro says the case lacks merit. He says the treaty doesn't deal with fishing or Bass Island.
Separately, Petro has rejected a large land claim filed by the Eastern Shawnee Tribe of Oklahoma.
