Outgoing Sen. Tom Daschle (D-South Dakota) will ask a federal judge to dismiss an Indian voter intimidation lawsuit against Republican John Thune, the winner of last week's election.
The judge had granted Daschle a temporary restraining order that prohibited Republican party workers from following Indian voters or writing down license plates of vehicles that took Indian voters to the polls. The order only applied in Charles Mix County, where members of the Yankton Sioux Tribe went to vote.
The judge dissolved the order last Wednesday after the election was over.
