The Virginia Supreme Court has been asked to resolve a treaty rights dispute involving the Mattaponi Tribe and the construction of a reservoir.
The tribe says the reservoir violates a 1677 treaty signed with the king of England. The tribe, which lacks federal recognition, lives on the Mattaponi River.
A state appeals court upheld a decision to allow the reservoir but referred the treaty rights question to the high court. The U.S. Army Corps of Engineers is still reviewing the project.
