An attempt by Sen. Pete Domenici (R-N.M.) to attach the energy policy legislation as an amendment to an unrelated bill by Sen. Tom Daschle (D-N.M.) failed on Thursday.

Domenici put the bill on Daschle's ethanol production, which itself was an amendment to an Internet tax bill. Known as a second-degree amendment, the procedure needed 60 votes to clear both the Domenici and Daschle proposals. Both votes failed.

The energy bill has stalled in the Senate for the past two years. It contains a section to limit the Department of Interior's involvement in energy projects on Indian land. In those cases, the department would not be liable for any breaches of trust.
