State expects another appeal in Tohono O'odham casino suit

The state of Arizona is anticipating yet another appeal in the Tohono O'odham Nation off-reservation gaming case, this time over attorney's fees and expenses.

The tribe has prevailed so far in its efforts to have land placed in trust for the West Valley Resort in the metro Phoenix area. But the state is disputing the tribe's request for $4.2 million in fees for winning one aspect of the case.

The legal maneuvers come as the House Natural Resources Committee considers H.R.1410, a bill that prevents the tribe from opening the casino. The Keep the Promise Act bars Class II and Class III gaming on land placed in trust in the metro Phoenix area after April 9, 2013.

The markup for the bill takes place tomorrow at 10am.
