1. POLICY:
UPCOMING IRS WEBINARS AND TREASURY CONSULTATIONS
The Internal Revenue Service (IRS) is hosting two identical webinars to discuss and review federal tax responsibilities for non-employee payments for tribes and tribal entities scheduled from 12 p.m. – 4 p.m. Eastern Time on November 6th and 13th.

The webinars will cover basic information for accounts payable employees and those responsible for filing Forms 1099 and Form 945.

The U.S. Department of the Treasury (Treasury) and IRS are scheduling consultations on the recently issued a Notice of Proposed Rulemaking for the implementation of section 139E of the Internal Revenue Code, created by the Tribal General Welfare Exclusion Act.

Consultations will be held on each November 18th, 19th, and 20th and written comments must be received by December 17th.

3. FOR TRIBAL LEADERS:
TRIBAL COMMENTS ON CONTRACT SUPPORT COSTS DUE 10/11
Tribes can make their voices heard and submit comments on IHS’s (Indian Health Service’s) implementation of Becerra v San Carlos Apache. The decision states IHS must pay tribes Contract Support Costs on expenditures tribes make on health care expenses – which will mean additional funding of up to $1 billion annually for Indian Country. However, IHS has introduced two avenues to potentially reduce this new funding – for CSCs on services to non-beneficiaries, and offsets for duplication of CSC payments in 3rd party revenues.

IHS will hold a consultation on Oct. 9th from 1 – 5 p.m. Eastern Time and written comments will be accepted through October 11th. The Tribal CSC Advisory Group has provided tribal leaders with suggested talking points in response to IHS’s consultation questions.

NAFOA encourages tribes and tribal health entities to submit a comment letter to consultation@ihs.gov by the Oct. 11 deadline, opposing IHS’s positions on the areas that, if implemented by IHS, would greatly reduce the funding Tribes are entitled to. IHS has requested commenters use the subject line: CSC Methodology for Program Income.

4. ACCOUNTING:
GASB SURVEY ON FAIR VALUE POST-IMPLEMENTATION REVIEW
The Governmental Accounting Standards Board (GASB) is conducting a survey to gather feedback from preparers of government financial statements as part of its Post-Implementation Review (PIR) of the fair value standards in GASB Statement No. 72, Fair Value Measurement and Application. The survey is part of a GASB research effort that will help the Board (1) determine whether the Statement is accomplishing its stated purpose, (2) evaluate the Statement’s implementation and continuing application costs and related benefits, and (3) obtain feedback to improve the standard-setting process.

The survey should take approximately fifteen minutes to complete. It can be accessed by clicking the link below which may be shared with other preparers of governmental financial statements.

The deadline for completing the survey is Friday, October 18, 2024.

5. JOBS:
TRIBAL CHIEF FINANCIAL OFFICER, SHAKOPEE MDEWAKANTON SIOUX COMMUNITY
The Chief Financial Officer (CFO) manages business and financial services to support the tribal mission and vision while supporting the SMSC ‘s Business Council objectives. The CFO will be a key strategic partner, responsible for overseeing the company’s financial planning, budgeting, and forecasting, as well as driving operational and financial performance to support the tribe’s growth objectives.

The CFO will ensure that the tribe derives maximum benefits from the expenditure of tribal financial resources; provides information and serves as a resource to others; achieves defined objectives by planning, evaluating, developing, implementing, and maintaining services in compliance with established guidelines; and serves as a member of the Business Council leadership team. The successful candidate will be responsible for the SMSC entire financial reporting portfolio, supporting business & economic development objectives with detailed forecasting, and establishing strong interpersonal & trusting working relationships with the SMSC Business Council and SMSC General Council members.
