Cherokee Nation father files appeal in Oklahoma's highest court

Dusten Brown, a member of the Cherokee Nation who is fighting to retain custody of his daughter, filed an appeal with the Oklahoma Supreme Court on Friday.

The custody case is sealed but it appears the Nowata County court on Friday issued an order for Brown to hand over his daughter to a non-Indian couple from South Carolina. The order would have required "immediate delivery" of the child.

The Supreme Court, however, put a hold on the order later on Friday after hearing Brown's request for an emergency stay, according to the docket for the appeal.

The Supreme Court has scheduled a hearing at 2pm today.
