Indian inmates in court over tobacco policy in South Dakota

A federal judge heard arguments today in a lawsuit filed by Indian inmates in South Dakota.

Inmates were allowed to use tobacco during ceremonies up until 2009. The policy changed because the South Dakota Department of Corrections said tobacco was being separated from bundles and pipe mixtures for smoking or bartering.

The Native American Council of Tribes says the policy infringes on the rights of the inmates and is discriminatory.
