Tribe asks judge to remove counties from recognition case

The Mishewal Wappo Tribe wants two counties in California removed from its federal recognition lawsuit.

Napa and Sonoma counties intervened in the tribe's lawsuit against the Interior Department. The tribe apparently didn't object at the time but is now asking a federal judge to remove them from the case for good.

The counties tried to have the lawsuit dismissed but Judge Edward Davila ruled against them. He also said they couldn't pursue an early appeal in the case

The tribe is in settlement talks with the Obama administration.
