A smoke shop that is licensed by the Yakama Nation of Washington reached a settlement with the state of Idaho over tobacco sales in that state.
The Lil' Brown Smoke Shop was accused of violating the Minors Access Act of Idaho by failing to obtain a state permit. The company was also accused of selling cigarettes over the Internet.
The company said it was protected by the Yakama Treaty of 1855. The 9th Circuit Court of Appeals has ruled that tribal members are free to bring goods to the market without state interference.
The terms of the settlement were not disclosed.
