A federal judge refused to bar the state of Oklahoma from seizing tobacco products being sold within the Muscogee (Creek)
Nation.
The tribe asked for a preliminary injunction, citing interference with in its dealings with other Indian businesses. But the judge said one of the manufacturers that was selling cigarettes to the tribe was not Indian owned.
The judge also said the state's attempt to ensure the tribe collects taxes on the sale of tobacco to non-Indians does not interfere with the tribe's sovereignty.
