The Santa Ysabel Band of Mission Indians of California elected a new chairman but its past leader refuses to go.
Johnny Hernandez won't turn over the keys to the tribal hall or give access to newly elected chairman Virgil Perez.
A lawsuit in the Intertribal Court of Southern California seeks to resolve the dispute.
"He is acting like a spoiled child and doesn't want to give up what he has," tribal member June Sortore told The San Diego Union-Tribune.
Perez and vice chair Brandie Taylor, who won re-election, filed the lawsuit. Hernandez tried to oust Taylor last year.
