The domestic violence and sexual assault compliance officer for the Rosebud Sioux Tribe said the U.S. Attorney's Office in South Dakota declined over 100 cases of sexual assault in 2006.

Lino Spotted Elk said the tribe referred 109 cases to federal prosecutors in that year. Of those, only nine were deemed actionable and only six resulted in charges, he said.

"Those 100 men who raped a woman, a child or a man -- because that's happening , too -- they walked. They just walked," Spotted Elk told The Rapid City Journal.

The newly-signed Tribal Law and Order Act requires the Department of Justice to report on the number of cases it declines to prosecute. Historically, most cases that are referred to federal prosecutors never result in charges.
