A federal judge has delayed the trial of a man accused of murdering American Indian Movement activist Anna Mae Pictou Aquash.
Richard Marshall, a member of the Oglala Sioux Tribe of South Dakota, requested more time to review information provided by police in Denver, Colorado. Judge Lawrence Piersol agreed to delay the trial until April 13.
Marshall was originally charged with John Graham, a Native man from Canada, for Aquash's murder on the Pine Ridge Reservation in December 1975. But federal prosecutors dropped charges against Graham because he is not an "Indian" as defined by federal law. Graham is being charged in state court.
Arlo Looking Cloud, Oglala Sioux, is serving a life sentence for Aquash's murder.
