A judge in Washington is moving forward with a lawsuit affecting a fireworks market on the Tulalip Reservation in Washington.
Guy Johnson bought fireworks from Louie Pablo, a member of the Tulalip Tribes. After suffering damage to his eye from a firework, Johnson sued Pablo, the tribe and Boom City, the biannual market where tribal members sell fireworks.
Boom City is located on tribal land but is not operated by the tribal government. For that reason, Judge George Appel says he doesn't think Boom City enjoys sovereign immunity.
But Appel dismissed the tribe from the suit, citing sovereign immunity. And he said Pablo, as a tribal member, can only be sued in tribal court.
