Tribes will ask Congress to "fix" the U.S. Supreme Court decision in Carcieri
v. Salazar, a Native American Rights Fund attorney said.
Richard Guest monitored the case for NARF's Tribal Supreme Court Project. He said tribes want Congress to amend the Indian Reorganization Act so that the land-into-trust process will apply to all tribes.
"I think you will see a broad effort by Indian tribes to fix what we would say is an oversight," Guest told The Providence Journal.
The court agreed with the state of Rhode Island that the land-into-trust process applies to tribes who were "under federal jurisdiction" in 1934. Tribes in nearby Connecticut, where similar issues were raised in a case that the court rejected, criticized the ruling but said they won't be affected.
