Retaliation case against Viejas Band dismissed
A former employee for the Viejas Band of Kumeyaay Indians won't be able to pursue claims that he was fired after he complained about a tribal elder.

Jamal Kanj filed a retaliation claim with the Department of Labor. A review board found that the tribe's immunity was abrogated by the whistleblower sections of the federal Clean Water Act.

But an administrative law judge dismissed the case, saying Kanj didn't file it on time. The tribe said it fired Kanj due to poor work performance.
