The U.S. Supreme Court won't be hearing Navajo
Nation v. U.S. Forest Service.
The justices, without comment, declined to accept the case. The order list was released this morning.
The 9th Circuit Court of
Appeals ruled that the U.S.
Forest Service did not violate the religious rights of tribes by allowing
the use of reclaimed wastewater in the sacred San Francisco Peaks of
Arizona. A ski resort plans to use the wastewater to create fake snow.
The Obama administration opposed review of the case. Tribal leaders had
hoped to settle the dispute before the court considered the petition.
