The Cayuga Nation of New York is asking a state court to prevent two counties from prosecuting the tribe on tax evasion charges.

The tribe was forced to shut down two smokeshops after they were raided by Cayuga and Seneca counties. Prosecutor said the tribe was selling cigarettes without paying state taxes.

The tribe went to court to challenge the raid but lost a ruling. The tribe is now asking an appellate court to halt prosecution pending a final decision on the tribe's ability to sell tobacco products.
