The Tsuu T'ina Nation of Alberta will move forward with an appeal of a contempt of court citation.
The band was held in contempt after it failed to restore power and water service to three homes on the reserve. The homes are the last remaining at Black Bear Crossing, which the band condemned.
The band argues it was against public safety to follow a court order that required the restoration of service.
The Alberta Court of Appeal agreed to hear the case.
