The Cayuga Nation of New York says its properties don't have to be in trust to enjoy a state tax exemption.
Attorney Daniel French said state tax code lists the tribe's business as "qualified reservation." He said that means authorities in Cayuga County had no right to raid two tribal smokeshops and seize tribal cash and property.
The tribe will be in state Supreme Court tomorrow to prevent the county from infringing on its rights.
