A six-month-old Indian baby is on his way to Minnesota after a judge in Utah declined to interfere with the rights of the Leech Lake Band of Ojibwe.
The tribe asserted jurisdiction over the welfare of Talon, whose mother is a tribal member. The judge in Utah agreed the child is "Indian" as defined by the Indian Child Welfare Act.
The baby's mother traveled to Utah to give birth. Talon was adopted by a non-Indian couple who didn't want to return him to the tribe.
Talon will be placed in foster care while the tribe makes a decision about his future.
