A Rhode Island state trooper goes on trial next week over his actions in the raid of the Narragansett Reservation on July 14, 2003.
Kenneth Jones is accusing of violating the civil rights of Adam Jennings, a member of the Narragansett Tribe. Jennings said Jones broke his ankle during the state's raid of a smoke shop on the reservation.
A jury awarded Jennings $301,000 for using excessive force and battery. But Judge Ernest C. Torres threw out of the award as a matter of law.
The 1st Circuit Court of Appeals reinstated the award in March 2007 and ordered Torres to consider motions he hadn't ruled on. Torres then granted the state's motion for a new trial.
