Ho-Chunk Nation loses suit over tobacco tax
Friday, May 2, 2008
The
Ho-Chunk Nation of Wisconsin
isn't entitled to a cigarette tax refund, a state appeals court
ruled
on Thursday.
The tribe wanted a refund of an undisclosed amount of taxes paid in 2003 and 2004. The tribe said the sales occurred on tribal trust property.
But the 4th District Court of Appeals ruled that the land at issue was taken into trust after a January 1, 1983, deadline in a state law. The
Bureau of Indian Affairs
didn't approve the deed until January 31, 1983, the court said.
