The police chief for the
Rosebud Sioux
Tribe of South Dakota said all of his officers are federally certified.
Chief Charles Red Crow said the officers are certified through the tribe's self-determination contract with the Bureau of Indian Affairs. "We have met every requirement leading to the certification process," Red Crow told The Rapid City Journal. "They met the guidelines under the 638 contract. That's the key."
But attorney Dana Hanna says 638 certification isn't enough. Hanna is representing a Rosebud man who is seeking to suppress evidence gathered by tribal officers because they weren't properly certified under federal or tribal law.
Tribal law has already led to the dismissal of more than 200 criminal cases in tribal court.
