Massachusetts will ask a federal judge to dismiss a lawsuit that challenges tribal preference provisions in the state's gaming law, The New Bedford Standard-Times reports. The state says the lawsuit has been rendered moot because the Massachusetts Gaming Commission voted to open the southeastern region to non-Indian bidders. That was one of the remedies sought by K.G. Urban Enterprises, a non-Indian developer that wants to compete for the casino. The H.3702, the Massachusetts Expanded Gaming Act gave preference for the Region C casino to "a federally recognized tribe." But the commission decided not to wait for the Mashpee Wampanoag Tribe to finish the land-into-trust process and gain approval for a Class III gaming compact. Get the Story:
