The 6th Circuit Court of Appeals won't let the Bay Mills Indian Community of Michigan reopen its off-reservation casino.
The tribe asked for a stay of a federal judge's decision to shut down the facility in Vanderbilt. The 6th Circuit, however, said the tribe has not "demonstrated a strong likelihood of success on the merits of this appeal." In a lawsuit filed by the state of Michigan and the Little Traverse Bay Bands of Odawa Indians, Judge Paul L. Mahoney ruled that the Bay Mills casino violates the Indian Gaming Regulatory Act.
