March 23 hearing set in Bay Mills off-reservation casino dispute

A federal judge will hold a hearing on March 23 in the Bay Mills Indian Community off-reservation casino lawsuit.

The tribe opened the casino last November. The facility is located on land that has not been taken into trust but the tribe says it qualifies for gaming in connection with a land claim settlement.

The Little Traverse Bay Bands of Odawa Indians and the state of Michigan are suing the Bay Mills Indian Community to shut down the casino. The federal government is not a party to the litigation but has said the site does not qualify under the Indian Gaming Regulatory Act

The Bay Mills Indian Community is raising a sovereign immunity defense.
