A member of the Mashpee Wampanoag Tribe of Massachusetts wants to reopen the land claim the tribe lost in the 1970s.
The federal courts threw out the claim because a jury ruled that the Wampanoags were not an Indian tribe when their land was taken out of their possession.
But now that the tribe has federal recognition, Amelia Bingham says any Wampanoag descendant can revive the case.
Tribal leaders disagree. They promised not to reopen the case in exchange for the support of the town of Mashpee on the tribe's federal recognition petition and future land-into-trust applications.
The issue will be discussed when the tribe and the town meet behind closed doors on Wednesday.
