Part 200. This is the most substantial update since inception in December 2013 and are the culmination of the required five-year review of the guidance as outlined in\u00a0<a href=\"https:\/\/www.ecfr.gov\/cgi-bin\/text-idx?SID=a06e564981fef3169525bd8e8cb5eb7d&amp;mc=true&amp;node=se2.1.200_1109&amp;rgn=div8\" target=\"_blank\" rel=\"noopener noreferrer\">2 C.R.F 200.109<\/a>.<\/p>\n<p>NAFOA submitted a\u00a0<a href=\"https:\/\/mcusercontent.com\/5fdaa92d88375a474b912b0f3\/files\/ec25efe5-8669-4a97-9dd7-73bb6783e2f7\/20200323_NAFOA_OMB_Uniform_Guidance_Comments_Final.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">comment letter<\/a>\u00a0earlier this year after meeting with Indian Country audit and law professionals expressing our concerns regarding public posting of Negotiated Indirect Cost Rates (NICR) of Indian tribes or tribal organizations.<\/p>\n<p><em><a href=\"https:\/\/nafoa.org\/broadcasts\/omb-updates-uniform-guidance-and-releases-compliance-supplement\" target=\"_blank\" rel=\"noopener noreferrer\">Read NAFOA&#8217;s broadcast for more details and information.<\/a><\/em><\/p>\n<h2 class=\"null\">3. <em>MORE\u00a0POLICY:<\/em><\/h2>\n<h2 class=\"null\">SEC MODERNIZES ACCREDITED INVESTOR DEFINITION AND INCLUDES INDIAN TRIBES<\/h2>\n<p>On August 26, 2020, the Securities and Exchange Commission (SEC) published\u00a0<a href=\"https:\/\/mcusercontent.com\/5fdaa92d88375a474b912b0f3\/files\/18e94d23-ee5d-4a81-8357-65cca659b745\/33_10824.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">Final Rule Amending the &#8220;Accredited Investor&#8221; Definitio<\/a><a href=\"https:\/\/mcusercontent.com\/5fdaa92d88375a474b912b0f3\/files\/18e94d23-ee5d-4a81-8357-65cca659b745\/33_10824.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">n\u00a0<\/a><a href=\"https:\/\/mcusercontent.com\/5fdaa92d88375a474b912b0f3\/files\/18e94d23-ee5d-4a81-8357-65cca659b745\/33_10824.pdf\" target=\"_blank\" rel=\"noopener noreferrer\">(RIN 3235-AM19)<\/a>. In this final rule the SEC adopted amendments to update and improve the definition of Accredited Investor and Qualified Institutional Buyers (QIB).<\/p>\n<p>The amendments expand the list of entities that may qualify as accredited investors, including Indian Tribes and entities formed under tribal law, that own investments in excess of $5 million USD.
