Photo by Indianz.Com (CC BY-NC-SA 4.0)<\/p><\/div>\n<p>The U.S. Supreme Court is set to hear arguments in <a href=\"https:\/\/sct.narf.org\/caseindexes\/mnuchin_v_chehalis.html\"><em>Yellen v. Confederated Tribes of the Chehalis Reservation<\/em><\/a>&nbsp;and&nbsp;<a href=\"https:\/\/sct.narf.org\/caseindexes\/alaska_native_corp_v_chehalis.html\"><em>Alaska Native Village Corporation Association v. Confederated Tribes of the Chehalis Reservation&nbsp; <\/em><\/a>on Monday, April 19, 2021.<\/p>\n<p>The hearing is scheduled to start at 10am Eastern. It will last one hour although the justices tend to go long whenever they hear Indian law disputes.<\/p>\n<p>At issue is whether <a href=\"https:\/\/en.wikipedia.org\/wiki\/Alaska_Native_corporation\">Alaska Native Corporations<\/a> (ANCs) are entitled to COVID-19 payments from the <a href=\"https:\/\/home.treasury.gov\/policy-issues\/cares\">Coronavirus Aid, Relief and Economic Security Act<\/a>, also known as the&nbsp;<a href=\"https:\/\/www.indianz.com\/Video\/2020\/03\/30\/cares-act-coronavirus-relief-f.asp\">CARES Act<\/a>. Last fall, the D.C. Circuit Court of Appeals ruled that the <a href=\"https:\/\/www.indianz.com\/News\/2020\/09\/25\/appeals-court-sides-with-tribes-in-covid-19-funding-dispute\/\">ANCs are not able to receive payments<\/a> because they are not recognized in the same manner as Indian nations, whose governments are in a nation-to-nation relationship with the U.S. government.<\/p>\n<p>The Trump administration, which supported the ANCs receiving COVID-19 relief over objections from Indian nations, appealed the D.C. Circuit ruling. The <a href=\"https:\/\/twitter.com\/indianz\/status\/1347684991887667201\">Supreme Court agreed to hear the dispute<\/a> on January 8, just 12 days before Joe Biden became president.<\/p>\n<p>Despite the change in guard, the Biden administration has continued to pursue the matter. The <a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/doj033121.pdf\">Department of Justice even agreed to share argument time<\/a> with the ANCs, a request that was granted by the <a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/041621zr_g3bi.pdf\">Supreme Court in an order<\/a> on Friday afternoon.<\/p>\n<a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/041621zr_g3bi.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"both\" data-toolbar-fixed=\"on\">041621zr_g3bi<\/a>\n<p>&nbsp;<\/p>\n<p>The tribal side of the argument has been somewhat murky. The <a href=\"http:\/\/www.utetribe.com\">Ute Tribe<\/a>, whose leaders filed one of the lawsuits challenging the Trump administration&#8217;s prior determination, asked to share time with an attorney for the other Indian nations but was denied in the <a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/041621zr_g3bi.pdf\">order on Friday<\/a>.<\/p>\n<p>The <a href=\"https:\/\/www.supremecourt.gov\/Search.aspx?FileName=\/docket\/docketfiles\/html\/public\\20-543.html\">Supreme Court docket sheet for Case&nbsp;No. 20-543<\/a> shows the competing motions for oral argument from the <a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/ute033121.pdf\">attorneys for the Ute Tribe<\/a> and the <a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/ute033121.pdf\">attorneys for other tribal governments<\/a> that have been part of the litigation. On Thursday, the <a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/chehalis041521.pdf\">latter group of attorneys<\/a> said they did not object to the Ute Tribe sharing argument.<\/p>\n<p>Later on Friday afternoon, following the first order, the Supreme Court took action again and assigned <a href=\"https:\/\/nativelawgroup.com\/attorneys\/jeffrey-s-rasmussen\/\">attorney Jeff Rasmussen<\/a>, who represents the Ute Tribe, to present the <a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/supremecourtdaycall041921.pdf\">entire argument alone<\/a>.<\/p>\n<p>According to the <a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/supremecourtdaycall041921.pdf\">day call for Monday<\/a>, Matthew Guarnieri, who is an Assistant to the Solicitor General at the <a href=\"https:\/\/www.justice.gov\/\">Department of Justice<\/a>, and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Paul_Clement\">Paul Clement<\/a>, a high-profile attorney who has <a href=\"https:\/\/www.kirkland.com\/lawyers\/c\/clement-paul-d\">argued more cases before the Supreme Court<\/a> than any other person, will share 30 minutes of time. Clement represents the ANCs.<\/p>\n<p>Rasmussen will then have 30 minutes to argue the tribal side of the case.<\/p>\n<a href=\"https:\/\/indianz.com\/covid19\/wp-content\/uploads\/2021\/04\/16\/supremecourtdaycall041921.pdf\" class=\"pdfemb-viewer\" style=\"\" data-width=\"max\" data-height=\"max\" data-toolbar=\"both\" data-toolbar-fixed=\"on\">supremecourtdaycall041921<\/a>\n<p>&nbsp;<\/p>\n<p>The CARES Act provided $8 billion in COVID-19 relief to tribal governments. Of that amount, all but about $534 million has been <a href=\"https:\/\/www.indianz.com\/News\/2020\/09\/25\/spreadsheet-coronavirus-relief-fund-allocations-for-tribal-governments\/\">distributed by the Department of the Treasury<\/a>, with former Secretary Steven Mnuchin overseeing the process during the onset of the pandemic in 2020.<\/p>\n<p>Should the Supreme Court side with the Biden administration and the ANCs, the Alaska corporations would be entitled to payments from the remaining $534 million. However, <a href=\"https:\/\/twitter.com\/SecYellen\">Secretary of the Treasury Janet Yellen<\/a> has since engaged in new consultations with tribes to determine whether the prior allocation method was fair, in response to yet another CARES Act lawsuit known as <em><a href=\"https:\/\/indianz.com\/covid19\/2021\/02\/25\/cares-act-litigation-shawnee-tribe-v-yellen-shawnee-tribe-v-mnuchin-2\/\">Shawnee Tribe v. Yellen<\/a><\/em>.<\/p>\n<p>The outcome of those discussions, as well as the forthcoming ruling from the Supreme Court, will have an impact on how the remaining $534 million is distributed, as the <a href=\"https:\/\/indianz.com\/covid19\/2021\/01\/05\/cares-act-decision-shawnee-tribe-v-mnuchin\/\">D.C. The&nbsp;plaintiffs in&nbsp;<em>Confederated Tribes of the Chehalis Reservation v. Yellen&nbsp;<\/em>are:<\/p>\n<ul>\n<li>Confederated Tribes of the Chehalis Reservation (Washington)<\/li>\n<li>Tulalip Tribes (Washington)<\/li>\n<li>Houlton Band of Maliseet Indians (Maine)<\/li>\n<li>Akiak Native Community (Alaska)<\/li>\n<li>Asa\u2019carsarmiut Tribe (Alaska)<\/li>\n<li>Aleut Community of St. Paul Island (Alaska)<\/li>\n<li>Navajo Nation (Arizona, New Mexico, Utah)<\/li>\n<li>Quinault Nation (Washington)<\/li>\n<li>Pueblo of Picuris (New Mexico)<\/li>\n<li>Elk Valley Rancheria (California)<\/li>\n<li>San Carlos Apache Tribe (Arizona)<\/li>\n<\/ul>\n<p>The plaintiffs in&nbsp;<em>Cheyenne River Sioux Tribe v. Yellen<\/em>&nbsp;are:<\/p>\n<ul>\n<li>Cheyenne River Sioux Tribe (South Dakota)<\/li>\n<li>Rosebud Sioux Tribe (South Dakota)<\/li>\n<li>Oglala Sioux Tribe (South Dakota)<\/li>\n<li>Nondalton Tribal Council (Alaska)<\/li>\n<li>Native Village of Venetie (Alaska)<\/li>\n<li>Arctic Village Council (Alaska)<\/li>\n<\/ul>\n<p>The third case is&nbsp;<em>Ute Indian Tribe of the Uintah and Ouray Indian Reservation v. Yellen<\/em>. The sole plaintiff is:<\/p>\n<ul>\n<li>Ute Indian Tribe (Utah)<\/li>\n<\/ul>\n<p>The Supreme Court has been holding arguments virtually since the onset of COVID-19 in March 2020.
