During the Barack Obama administration, tribes  were asked about changing the practice but an exemption ultimately was not included in <a href=\"https:\/\/indianz.com\/News\/2015\/06\/29\/bia-to-announce-longawaited-fe.asp\">regulations finalized in 2015<\/a> amid controversy generated by Republicans on Capitol Hill.\r\n<p><\/p>\r\nFive years later, Judge Ronald B. Leighton ruled that blanket ban is &#8220;arbitrary and capricious&#8221; because it isn&#8217;t supported by  sufficient evidence in the record. He ordered the <a href=https:\/\/www.doi.gov\/>Department of the Interior<\/a>, the parent agency of the BIA, to take another look at the  matter after the <a href=\"https:\/\/chinooknation.org\/\">Chinook Nation<\/a>, based in Washington state, challenged the  re-petitioning policy.\r\n<p><\/p>\r\n&#8220;The decision to maintain the re-petition ban in the 2015 final rule was thus arbitrary and capricious and must be remanded to DOI for further evaluation consistent with this order,&#8221; Judge Ronald B. Several were open to getting rid of the ban, arguing that historic Indian nations, particularly those on the East Coast and in the Southeast, should be given a fair shot at securing federal acknowledgment of their status.\r\n<p><\/p>\r\nAs for the Chinook Nation, the tribe secured a <a href=\"https:\/\/indianz.com\/News\/show.asp?ID=law\/142001-1\">favorable decision on its federal recognition petition<\/a> during the final days of the Bill Clinton era. But the  <a href=\"https:\/\/indianz.com\/News\/show.asp?ID=2002\/07\/08\/chinook\">George W. Bush  administration reversed course<\/a> in 2002, <a href=\"https:\/\/indianz.com\/News\/2018\/05\/08\/chinook-nation-in-court-to-battle-federa.asp\">leading to litigation<\/a> that <a href=\"https:\/\/chinooknation.org\/chinook-in-the-news\/recognition_law_suit\/recognition_press.html\">continues in federal court<\/a>.\r\n<p><\/p> \r\nJust last month, Leighton ordered the BIA to re-examine whether the tribe is a &#8220;successors in interest&#8221; to Chinook groups that previously  secured monetary judgments from the Indian Claims Commission.
