Photo courtesy Candy Brings Plenty<\/figcaption>\r\n<div class=h1-responsive>&#8216;Your silence votes for you&#8217;: Citizens of Oglala Sioux Tribe target council over impeachment vote<\/div>\r\n<div class=\"date\">Thursday, September 17, 2020<\/div>\r\n<div class=\"byline\">By <A href=\"https:\/\/twitter.com\/Kevin_Abourezk\">Kevin Abourezk<\/A> <A href=\"https:\/\/twitter.com\/Kevin_Abourezk\"><I aria-hidden=true class=\"fab fa-twitter\"><\/I><\/A><\/div>\r\n<div class=\"source\">Indianz.Com<\/div>\r\n<p><\/p>\r\nThe mother of a young Lakota man who accused <a href=https:\/\/www.facebook.com\/BearRunnerForOglalaNationPresident\/>President Julian Bear Runner<\/a> of the <a href=https:\/\/oglalalakotanation.info\/>Oglala Sioux Tribe<\/a> of coercing him into sex filed a second complaint as citizens came together to support two spirits and youth on the <a href=https:\/\/en.wikipedia.org\/wiki\/Pine_Ridge_Indian_Reservation>Pine Ridge Reservation<\/a> in South Dakota.\r\n<P><\/p>\r\nOn Monday, the tribal council voted 11-5 to impeach Bear Runner, <a href=https:\/\/indianz.com\/News\/?p=374>falling at least two votes short<\/a> of the two-thirds majority needed to remove the president from office. But Dana Richards said the vote wasn&#8217;t properly recorded <a href=https:\/\/youtu.be\/vsdXV4R1DnY>after the five-hour hearing<\/a>.\r\n<p><\/p>\r\nAccording to Richards, the technology used by the tribe failed to properly record some council members\u2019 votes, including those of Phillip Good Crow and Vincent Two Lance. Photo courtesy Candi Brings Plenty<\/figcaption><\/figure>\r\n<p><\/p>\r\nRichards said <a href=https:\/\/robertsrules.com\/>Robert\u2019s Rules of Order<\/a>, which are procedures used by some tribal councils, dictates that an official\u2019s silence during a vote should be recorded as a consenting vote. She said adding the votes of the four councilmembers who did not vote to the total would mean the council\u2019s votes should have been recorded as 15 in favor and 5 against the motion to impeach Bear Runner.\r\n<p><\/p>\r\nOn Wednesday, supporters of Richards\u2019 son, Richard Weston, protested the council\u2019s failure to impeach the president based on Weston\u2019s claims against Bear Runner.\r\n<p><\/p>\r\nAbout 20 protesters gathered in a park for speeches prior to marching several blocks and gathering again across the street from the tribe\u2019s main administrative building in the community of Pine Ridge.\r\n<p><\/p>\r\n\u201cIf you choose to withhold your votes, your silence votes for you,\u201d said Candi Brings Plenty, indigenous justice organizer for the ACLU of South Dakota and a two-spirit citizen of the Oglala Sioux Tribe, standing across the street from the tribe\u2019s main headquarters. \u201cWhen you choose to stand silent with a sexual predator or oppressor, you too are violating the victim.\u201d\r\n<p><\/p>\r\n<div class=row><div class=col-md-7>\r\n<div class=\"fb-video\" data-href=\"https:\/\/www.facebook.com\/CanteSkuya27\/videos\/3936831609665504\/\" data-show-text=\"false\" data-width=\"\"><blockquote cite=\"https:\/\/developers.facebook.com\/CanteSkuya27\/videos\/3936831609665504\/\" class=\"fb-xfbml-parse-ignore\"><a href=\"https:\/\/developers.facebook.com\/CanteSkuya27\/videos\/3936831609665504\/\"><\/a><p><\/p>Posted by <a href=\"#\" role=\"button\">Candi Brings Plenty<\/a> on Wednesday, September 16, 2020<\/blockquote><\/div><\/div>\r\n<div class=\"col-md-5 align-self-end\">\r\n<figcaption class=figure-caption>Video by Candi Brings Plenty: <a href=https:\/\/www.facebook.com\/CanteSkuya27\/videos\/3936831609665504\/>Rally on Pine Ridge Reservation &#8211; September 16, 2020<\/a>\r\n<\/figcaption>\r\n<\/div><\/div><p><\/p>\r\nEfforts to impeach Bear Runner began earlier this summer when Weston posted his allegations against the president on Facebook and his mother then submitted a complaint against Bear Runner to the tribal council, leading to the <a href=https:\/\/www.youtube.com\/watch?v=2CdgqXO2An8>impeachment hearing Monday<\/a>.\r\n<p><\/p>\r\nWeston has alleged that Bear Runner coerced him into letting him perform oral sex on him when Weston was only 17 years old and later coerced him into having sexual intercourse with him when he was 18.\r\n<p><\/p>\r\nDuring testimony Monday, Weston told the tribal council that he was 17 on February 10 when Bear Runner picked him up at his home near Porcupine, to take him to Pine Ridge where the two were going to meet the tribe\u2019s spokeswoman. He said Bear Runner drove him to a water tower near Wounded Knee and parked his pickup.\r\n<p><\/p>\r\nBear Runner then coerced him into allowing him to give the minor oral sex.\r\n<p><\/p>\r\n\u201cAfter that, I kept to myself because I was ashamed because of what happened,\u201d Weston said, fighting tears. \u201cI kept that from my mother and everyone else. The only other person that knew was Julian.\u201d\r\n<p><\/p>\r\nHe said Bear Runner kept contacting him afterward, sending him messages using <a href=https:\/\/www.snapchat.com\/add\/indianzcom>Snapchat, an application<\/a> that allows users to send messages that are deleted shortly after they are opened by the recipient.\r\n<p><\/p>\r\nHe told the tribal council that on June 17 he again had sex with Bear Runner after the tribal president gave him a ride to Rapid City, South Dakota, and paid for a hotel room for the two of them. When they got to the hotel room, Bear Runner took off most of his clothes of got into bed with Weston and began hugging him.\r\n<p><\/p>\r\nWeston said Bear Runner convinced him to have sexual intercourse with him.\r\n<p><\/p>\r\n\u201cHe convinced me to say yes,\u201d Weston said. \u201cI felt violated. Photo by <A href=\"\/m.asp?url=https:\/\/twitter.com\/Kevin_Abourezk\">Kevin Abourezk <I aria-hidden=true class=\"fab  fa-twitter\"><\/I><\/A>\r\n<\/figcaption><\/figure>\r\n<p><\/p>\r\nIn his defense Monday, Bear Runner asked the tribal council to dismiss Richards&#8217;s complaint so a tribal court could adjudicate a cease and desist order that Bear Runner filed, alleging defamation of character against him by Richards and her son.\r\n<p><\/p>\r\nAnd he defended himself against the allegations made by Weston, denying he had sex with Weston during the two incidents that he told the tribal council about.\r\n<p><\/p>\r\nBut Bear Runner admitted that he picked up Weston the morning of February 10 to give him a ride to Pine Ridge to meet the tribe\u2019s spokeswoman, Karin Eagle, who planned to take Weston with her to Pierre to take part in a rally and a legislative hearing on a <a href=https:\/\/sdlegislature.gov\/Legislative_Session\/Bills\/Bill.aspx?Bill=1057&#038;Session=2020>bill that would have penalized doctors<\/a> for providing puberty blockers and gender confirmation surgery to transgender children under age 16.\r\n<p><\/p>\r\nThe <a href=https:\/\/www.facebook.com\/donate\/816638052144835\/180266426640939\/>South Dakota Legislature failed to pass<\/a> the bill.\r\n<p><\/p>\r\nBear Runner said he had picked up Weston around 5:30 a.m. that morning and got him to Pine Ridge shortly after 6 a.m., meaning he wouldn\u2019t have had time to have sex with Weston. Weston had claimed he and Bear Runner didn\u2019t make it to Pine Ridge until almost 8 a.m., and he offered a screenshot with the tribal council showing he sent Eagle a text message shortly before 8 a.m. saying they were almost to Pine Ridge.\r\n<p><\/p>\r\nBear Runner said if he and Weston hadn\u2019t arrived at the <a href=https:\/\/www.facebook.com\/Big-Bats-114488205303773\/>Big Bat\u2019s convenience store<\/a> until almost 8 a.m., Eagle and Weston wouldn\u2019t have been able to make the three-hour drive to Pierre, South Dakota, in time for the 9 a.m. <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2020\/09\/65770.pdf>legislative hearing<\/a>. We love him more and more each day about it.\u201d\r\n<p><\/p>\r\nHe said he hopes his son\u2019s stance will inspire other two-spirit tribal citizens.\r\n<p><\/p>\r\n\u201cThey shouldn\u2019t be ashamed to come out because they are our sacred people, too,\u201d he said. \u201cThey are part of our <em>tiospaye<\/em>, our <em>oyate<\/em>, they bring harmony to our tribes, our reservation.\u201d\r\n<p><\/p>\r\nFallout from the failed impeachment vote was immediate on Monday. He <a href=https:\/\/www.facebook.com\/363891590650357\/videos\/2672876932958974\/>returned to work<\/a> in early August.\r\n<P><\/p>\r\nImmediately following his earlier suspension, Bear Runner shared some personal information. In a post on social media, he said he had &#8220;recently come to terms&#8221; with his bisexuality.\r\n<P><\/p>\r\nIn early May, Bear Runner acknowledged he had been <a href=https:\/\/indianz.com\/News\/2020\/05\/04\/president-of-oglala-sioux-tribe-admits-a.asp title=\"President of Oglala Sioux Tribe admits arrest during coronavirus crisis\">arrested by tribal police<\/a>.
