Photo courtesy <a href=http:\/\/www2.sbtribes.com\/united-states-supreme-court-decision-confirms-tribal-jurisdiction-over-fmc\/>Shoshone-Bannock Tribes<\/a>\r\n<\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Tribes prevail in fight with chemical company<\/div>\r\n<div class=\"h5-responsive sub\">The US Supreme Court has declined to hear a challenge by FMC Corp., meaning the Shoshone-Bannock can regulate cleanup, charge $1.5M waste fees<\/div>\r\n<div class=\"date\">Wednesday, January 13, 2021<\/div>\r\n<div class=\"source\">Indian Country Today<\/div>\r\n<div class=\"source-website\"><a href=\"https:\/\/indiancountrytoday.com\/\">indiancountrytoday.com<\/a><\/div>\r\n<P><\/P>\r\nThe <a href=\"http:\/\/www.sbtribes.com\/\">Shoshone-Bannock Tribes<\/a> can continue charging food and chemical conglomerate FMC Corp. a fee of $1.5 million a year for storing hazardous waste on reservation land.\r\n<P><\/P>\r\nThe <a href=https:\/\/twitter.com\/indianz\/status\/1348664799643770880>U.S. Supreme Court on Monday declined<\/a> to hear a challenge to a lower court decision in the tribes\u2019 favor.\r\n<P><\/P>\r\nIn 2019, the <a href=https:\/\/indianz.com\/News\/2019\/11\/18\/shoshonebannock-tribes-win-regulatory-ca.asp>9th U.S. Circuit Court of Appeals ruled that the Shoshone-Bannock Tribes could charge FMC a fee<\/a> for storing the waste from its now-closed phosphorus processing plant on the Fort Hall Indian Reservation in Idaho. The ruling by the three-judge appeals court panel said the tribes have jurisdiction over the company.\r\n<P><\/P>\r\n<div class=\"fb-post\" data-href=\"https:\/\/www.facebook.com\/shobantribes\/posts\/10159140976856941\" data-width=\"552\" style=\"background-color: #fff; display: inline-block;\"><\/div>\r\n<p><\/p>\r\nChairman Devon Boyer said he was pleased with the high court&#8217;s decision and that &#8220;FMC is finally required to honor their agreement to comply with tribal jurisdiction.&#8221;\r\n<P><\/P>\r\n&#8220;This decision helps all of Indian Country in efforts to protect tribal lands and natural resources as well as the betterment of all people of southeast Idaho,&#8221; Boyer <a href=http:\/\/www2.sbtribes.com\/united-states-supreme-court-decision-confirms-tribal-jurisdiction-over-fmc\/>said in a statement<\/a>. \r\n<p><\/p>\r\n\r\nGregory G. Garre, an attorney for FMC Corp., previously argued that the company shouldn\u2019t have to pay the fee. He told the 9th Circuit panel that the tribes\u2019 demand could be in perpetuity because the waste from the former production plant is now a Superfund site, and a safe cleanup could take decades.\r\n<P><\/P>\r\nFMC had paid the fee from 1998 to 2001 after reaching an agreement with the tribe. Eventually the case reached a tribal appeals court, which found the money was owed because FMC\u2019s storage of hazardous waste on the reservation created an \u201congoing and extensive threat to human health\u201d and put important cultural practices at risk. The site is near the Portneuf River and Fort Hall Bottoms, where groundwater contamination threatens subsistence fishing, hunting and gathering by tribal members, the court said.\r\n<P><\/P>\r\nThe 9th Circuit then held that the tribal court had regulatory and adjudicatory jurisdiction over the Shoshone-Bannock Tribes\u2019 lawsuit against FMC under two \u201cMontana exceptions&#8221; involving tribal authority over non-Indians. The appeals court said the tribe has inherent power when the actions of a company are a threat to the tribe&#8217;s economic security or the health and welfare of citizens.\r\n<P><\/P>\r\nApproximately 22 million tons of hazardous waste is stored, according to the Shoshone-Bannock Tribes. \r\n<P><\/P>\r\n<div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><P><\/p>\r\nOn Monday, the Supreme Court denied the company\u2019s petition for a review of the 9th Circuit\u2019s decision.\r\n<P><\/P>\r\nOn social media, some cheered the high court&#8217;s decision to not hear the case.\r\n<P><\/P>\r\n<div class=\"fb-post\" data-href=\"https:\/\/www.facebook.com\/billy.keene.10\/posts\/1807609372737176\" data-width=\"552\" style=\"background-color: #fff; display: inline-block;\"><\/div>\r\n<p><\/p>\r\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\"><p lang=\"en\" dir=\"ltr\">Sovereignty wins another battle!!!<br>They need to clean up the ponds not cover them up!
