We have been left with no other choice but to file suit to protect our land, our culture, and our rights,\u201d <a href=\"https:\/\/www.tonation-nsn.gov\/tribal-government\/\">Tohono O\u2019odham Nation Chairman Verlon Jose<\/a> said <a href=\"https:\/\/acrobat.adobe.com\/id\/urn:aaid:sc:US:d487ba25-cfd0-4275-9f66-424fcb9fdea4\">in a statement<\/a> Wednesday announcing the lawsuit, which was filed the previous day in the U.S. District Court for the District of Columbia.\u00a0<\/p>\r\n<p>Jose highlighted the tribe\u2019s uses of vehicle barriers, technology and personnel in coordination with federal immigration officials.<\/p>\r\n<p>The Trump administration struck a conciliatory tone but made no indication it would back down. The DHS issued a response noting Homeland Security Secretary Markwayne Mullin\u2019s Indigenous heritage.\u00a0<\/p>\r\n<p>\u201cSecretary Mullin is a citizen of the Cherokee Nation and made clear during his confirmation hearing that he respects tribal sovereignty,\u201d the statement said. \u201cDHS is committed to ongoing coordination with stakeholders, including tribal nations, throughout planning and construction activities. President Donald Trump made building a border wall <a href=\"https:\/\/ecollections.law.fiu.edu\/faculty_publications\/430\/\">a central campaign promise<\/a> in 2016.<\/p>\r\n<p>The remote span covered by the Tohono O\u2019odham reservation was relatively low priority, and not a huge magnet for smuggling of drugs or migrants.<\/p>\r\n<p>The push for a new section of wall across the tribe\u2019s land comes despite the Trump administration\u2019s boasts that <a href=\"https:\/\/www.cbp.gov\/newsroom\/national-media-release\/trump-administration-delivers-full-year-zero-releases-border\">illegal border crossings per month have dropped by as much as 95% in the last year.<\/a><\/p>\r\n<p>When Trump <a href=\"https:\/\/www.congress.gov\/bill\/119th-congress\/senate-bill\/2\">signed the Secure America Act<\/a> on June 10, providing Homeland Security funding through the end of his term, he asserted that his administration has created the \u201c<a href=\"https:\/\/www.whitehouse.gov\/releases\/2026\/06\/the-secure-america-act-ends-democrat-obstruction-fully-funds-cbp-ice-and-president-trumps-border-security-agenda\/\">most secure border in history.<\/a>\u201d<\/p>\r\n<p>The Tohono O\u2019odham emphasized in its court filings that, thanks in part to its own efforts, <a href=\"https:\/\/www.tonation-nsn.gov\/wp-content\/uploads\/2026\/06\/Myths-v-Facts-on-Border-Wall.pdf\">border detentions have dropped on tribal land by 95% as well<\/a>.\u00a0<\/p>\r\n<p>The Gadsden Purchase of 1854 placed about half of the tribe\u2019s territory south of the border, <a href=\"https:\/\/digitalcommons.law.seattleu.edu\/cgi\/viewcontent.cgi?article=1118&#038;context=ailj\">without the tribe\u2019s input<\/a>.\u00a0<\/p>\r\n<p>Until the creation of the Border Patrol in 1924, tribal members were able to move <a href=\"https:\/\/digitalcommons.law.seattleu.edu\/cgi\/viewcontent.cgi?article=1118&#038;context=ailj\">freely across the border on tribal land<\/a>.<\/p>\r\n<a href=\"https:\/\/indianz.com\/News\/2025\/08\/18\/native-america-calling-native-in-the-spotlight-with-michael-steven-wilson\/tohonooodhamnation\/\" rel=\"attachment wp-att-199381\"><img loading=\"lazy\" decoding=\"async\" width=\"2048\" height=\"1536\" data-attachment-id=\"199381\" data-permalink=\"https:\/\/indianz.com\/News\/2025\/08\/18\/native-america-calling-native-in-the-spotlight-with-michael-steven-wilson\/tohonooodhamnation\/\" data-orig-file=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2025\/08\/18\/tohonooodhamnation.jpg\" data-orig-size=\"2048,1536\" data-comments-opened=\"0\" data-image-title=\"Tohono O&amp;#8217;odham Nation\" data-image-description=\"&lt;p&gt;Tohono O&amp;#8217;odham Nation&lt;\/p&gt;\n\" data-image-caption=\"&lt;p&gt;A fence of the Tohono O&amp;#8217;odham Nation denotes the border between the United States and Mexico. Hendricks \/ Meditations on the Collapse<\/a><\/figcaption>\r\n<P><\/P>\r\n<p>The lawsuit notes that thousands of members live on tribal land south of the border, in 17 communities.<\/p>\r\n<p>\u00a0\u201cNation members regularly cross the border at multiple points (with the Department\u2019s knowledge) for important religious, family, and practical reasons,\u201d it says.<\/p>\r\n<p>The lawsuit asserts that a wall would reduce the tribe\u2019s territory, and offers details about the many measures the tribe has taken to support border security.<\/p>\r\n<p>Since 1974, the tribe has allowed federal border authorities to operate from permanent installations on its land.<\/p>\r\n<p>Customs and Border Protection has installed 160-foot towers at 10 sites since 2012 with surveillance cameras, night vision, thermal sensors and ground sweeping radar.<\/p>\r\n<p>CBP also operates all-terrain pickup trucks on tribal land. Federal authorities maintain vehicle checkpoints on the main highways between the reservation and Phoenix and Tucson.<\/p>\r\n<p>\u201cIn 2006, the Nation agreed to the construction of vehicle barriers and a patrol road along the vast majority of the border, with the exception of those areas where vehicle access is impossible due to mountainous terrain,\u201d the lawsuit says. \u201cThe vehicle barriers have eliminated unauthorized vehicle transit across the border. More generally, the measures that the Nation and Border Patrol have put in place on the Reservation have proven to be highly effective in preventing, deterring, and intercepting illegal crossings and smuggling within the Reservation.\u201d<\/p>\r\n<p>The chairman called the lawsuit a last resort.<\/p>\r\n<p>\u201cWe would prefer to be using our precious resources to improve the lives of our Nation members,\u201d he said.\u00a0<\/p>\r\n<iframe loading=\"lazy\" src=\"https:\/\/www.facebook.com\/plugins\/post.php?href=https%3A%2F%2Fwww.facebook.com%2Fpermalink.php%3Fstory_fbid%3Dpfbid0LuNeTtq7x9Y1TT6LSvmxv8bjrj1jnEqez6DxtoaxjjkaCFoxZhN6C1epEk635eGal%26id%3D61577254949466&#038;show_text=true&#038;width=500\" width=\"500\" height=\"734\" style=\"border:none;overflow:hidden\" scrolling=\"no\" frameborder=\"0\" allowfullscreen=\"true\" allow=\"autoplay;
