Photo: Lauren Miller, Montana Free Press, CatchLight Local\/Report for America<\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Tribal groups join lawsuit seeking restoration of $127 million in canceled farm grants<\/div>\r\n<div class=\"h5-responsive sub\">In March, the USDA canceled 49 grants, including at least three supporting Montana projects designed to support \u2018underserved\u2019 farmers and ranchers.<\/div>\r\n<div class=\"date\">Wednesday, May 27, 2026<\/div>\r\n<div class=\"byline\">By Nora Mabie<\/div>\r\n<DIV class=\"source\">Montana Free Press<\/DIV>\r\n<DIV class=\"source-website\"><A \r\nhref=\"https:\/\/montanafreepress.org\/\">montanafreepress.org<\/A><\/DIV>\r\n<p><\/p>\r\n<p>Twenty-four organizations, including one that serves tribes in Montana and the surrounding region, on Tuesday joined a lawsuit against the U.S. Department of Agriculture, alleging that grants supporting farmers and ranchers were unlawfully terminated.<\/p>\r\n\r\n<p>In March, the USDA canceled <a href=\"https:\/\/montanafreepress.org\/2026\/04\/02\/tribes-in-montana-lose-millions-after-usda-kills-farm-grants\/\">49 of 50 <\/a><a href=\"https:\/\/www.fsa.usda.gov\/programs-and-services\/increasing-land-access\">Increasing Land, Capital and Market Access Program<\/a> grants designed to support \u201cunderserved\u201d farmers and ranchers.<\/p>\r\n\r\n<p>At least three projects in Montana were affected: Piikani Lodge Health Institute, headquartered on the Blackfeet Reservation, lost a nearly $9 million grant to improve operations for farmers and ranchers in the region. The Chippewa Cree Tribe in north-central Montana lost a nearly $6 million award to purchase land and train young farmers and ranchers how to manage it. And South Dakota-based Four Bands Community Fund lost an $8.5 million grant to train and financially support at least 25 low-income agricultural producers in Montana, North Dakota, South Dakota and Wyoming. At the time, Montana-based awardees <a href=\"https:\/\/montanafreepress.org\/2026\/04\/02\/tribes-in-montana-lose-millions-after-usda-kills-farm-grants\/\">described the terminations<\/a> as \u201cdevastating.\u201d<\/p>\r\n\r\n<div class=\" content_cards_card content_cards_domain_indianz-com\">\n\t\t\t<div class=\"content_cards_image\">\n\t\t\t\t<a class=\"content_cards_image_link\" href=\"https:\/\/indianz.com\/News\/2026\/04\/03\/montana-free-press-tribes-lose-federal-grants-in-dei-purge-at-usda\/\">\n\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2026\/07\/03\/kimpaul.jpg\" alt=\"Montana Free Press: Tribes lose federal grants in DEI purge at USDA\">\t\t\t\t<\/a>\n\t\t<\/div>\n\t\n\t<div class=\"content_cards_title\">\n\t\t<a class=\"content_cards_title_link\" href=\"https:\/\/indianz.com\/News\/2026\/04\/03\/montana-free-press-tribes-lose-federal-grants-in-dei-purge-at-usda\/\">\n\t\t\tMontana Free Press: Tribes lose federal grants in DEI purge at USDA\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_description\">\n\t\t<a class=\"content_cards_description_link\" href=\"https:\/\/indianz.com\/News\/2026\/04\/03\/montana-free-press-tribes-lose-federal-grants-in-dei-purge-at-usda\/\">\n\t\t\t<p>The Trump administration has terminated millions of dollars in grants that were promised to tribal projects.<\/p>\n\t\t<\/a>\n\t<\/div>\n\t<div class=\"content_cards_site_name\">\n\t\t<img decoding=\"async\" src=\"https:\/\/www.indianz.com\/favicon.ico\" alt=\"Indianz.Com\" class=\"content_cards_favicon\"\/>\t\tIndianz.Com\t<\/div>\n<\/div>\r\n<P><\/P>\r\n<p>In several termination letters obtained by Montana Free Press, the USDA wrote that the grants had been canceled because the associated projects \u201cinvolved discriminatory preferences based on Diversity, Equity and Inclusion and wasteful spending that did little to further lawful agricultural land purchases.\u201d<\/p>\r\n\r\n<p>A lawsuit against the USDA seeking reinstatement of the grants was originally filed in June 2025, after several other grants were terminated following President Donald Trump\u2019s executive orders deprioritizing <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/04\/protecting-american-energy-from-state-overreach\/\">climate action<\/a> and <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/ending-radical-and-wasteful-government-dei-programs-and-preferencing\/\">Diversity, Equity and Inclusion<\/a> (DEI) programs. In August 2025, a federal judge in Washington, D.C., ordered the USDA to reinstate six grants awarded to the original plaintiffs. This week, 24 additional organizations, including Four Bands Community Fund, which serves Montana and other states in the region, joined the lawsuit.<\/p>\r\n\r\n<p>The new plaintiffs are represented by lawyers from a variety of advocacy organizations, including FarmSTAND, Farmers\u2019 Legal Action Group and Earthjustice. They argue that the USDA\u2019s March grant terminations were unlawful and have caused irreparable harm.<\/p>\r\n\r\n<p>\u201cPlaintiffs are faced with layoffs, abandoning projects and investments, reputational harm in the community for failing to deliver promised programs, and drastic reductions in their organizations\u2019 operations, or in some cases, having to shutter their organizations entirely,\u201d the complaint reads.<\/p>\r\n\r\n<p>USDA representatives could not immediately be reached for comment.<\/p>\r\n\r\n<blockquote class=\"bluesky-embed\" data-bluesky-uri=\"at:\/\/did:plc:tqfqj5toectfx672ilgyuxwm\/app.bsky.feed.post\/3mmtppibh4z2b\" data-bluesky-cid=\"bafyreibwdksf4nzor4r2m76qktogisr2y4evtdekljsjuti2ymzwovuklq\" data-bluesky-embed-color-mode=\"system\"><p lang=\"\">Trump\u2019s USDA illegally cut off funding for groups building a food system where more people can become farmers. We\u2019re suing the government to make sure they honor these grants. farmstand.org\/recently-shu&#8230;<br><br><a href=\"https:\/\/bsky.app\/profile\/did:plc:tqfqj5toectfx672ilgyuxwm\/post\/3mmtppibh4z2b?ref_src=embed\">[image or embed]<\/a><\/p>&mdash; FarmSTAND (<a href=\"https:\/\/bsky.app\/profile\/did:plc:tqfqj5toectfx672ilgyuxwm?ref_src=embed\">@farmstand.bsky.social<\/a>) <a href=\"https:\/\/bsky.app\/profile\/did:plc:tqfqj5toectfx672ilgyuxwm\/post\/3mmtppibh4z2b?ref_src=embed\">May 27, 2026 at 10:27 AM<\/a><\/blockquote><script async src=\"https:\/\/embed.bsky.app\/static\/embed.js\" charset=\"utf-8\"><\/script>\r\n<P><\/P>\r\n<p>The plaintiffs allege that the USDA terminated the grants \u201cwithout individualized review but rather based on vague allegations that the projects were not aligned with the President\u2019s newly stated goals of eliminating funding for DEI and climate initiatives \u2014 without any effort to determine whether the projects could be brought into line.\u201d<\/p>\r\n\r\n<p>The plaintiffs specifically allege that in 2023, Four Bands Community Fund was approved for an $8.5 million grant to increase access to land and capital in Mountain Plains tribal areas, but in March received notice that the grant had been terminated, in part because the project \u201cviolated equal protection principles by selecting beneficiaries based on race, ethnicity, sexual orientation, or sex.\u201d<\/p>\r\n\r\n<p>The plaintiffs describe the Four Bands grant termination as \u201cparticularly arbitrary and capricious,\u201d and argue that the federal government\u2019s reasoning \u201cignores the unique status of tribes, tribal citizens and tribal lands\u201d and \u201cfails to acknowledge tribal status is not a race-based classification,\u201d as would be subject to DEI programming. It\u2019s well established in federal Indian law that tribal citizenship is <a href=\"https:\/\/indianlaw.org\/news\/tribes-are-governments-not-racial-classifications\">a political classification<\/a>, not a racial one. <\/p>\r\n\r\n<p>Representatives of Four Bands Community Fund could not immediately be reached for comment.<\/p>\r\n\r\n<p>The plaintiffs are asking the United States District Court for the District of Columbia to restore the grant awards, which total $127 million, and prohibit the USDA from terminating the grants in the future.<\/p>\r\n<p><\/p>\r\n<strong>Note: This story originally <a href=\"https:\/\/montanafreepress.org\/2026\/05\/27\/tribal-groups-join-lawsuit-seeking-restoration-of-127-million-in-canceled-farm-grants\/\">appeared on Montana Free Press<\/a>.
