United States Department of the Army<\/a>\r\n<\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Winnebago Tribe celebrates precedent in burial of children at Indian boarding school<\/div>\r\n<div class=\"date\">Friday, May 15, 2026<\/div>\r\n<div class=\"byline\">By Acee Agoyo<\/div>\r\n<div class=\"source\">Indianz.Com<\/div>\r\n<p><\/p>\r\nThe <a href=\"https:\/\/winnebagotribe.com\/\">Winnebago Tribe<\/a> has scored a precedent-setting legal victory that paves the way for the repatriation of children buried at one of the most infamous symbols of the <a href=\"https:\/\/indianz.com\/z\/fibs\/\">genocidal Indian boarding era<\/a>.\r\n<p><\/p>\r\nBy a vote of 2-1, the <a href=\"https:\/\/www.ca4.uscourts.gov\">4th Circuit Court of Appeals<\/a> on Thursday sided with the tribe regarding the burials of two Winnebago boys who were taken from their community and sent hundreds of miles away to the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Carlisle_Indian_Industrial_School\">Carlisle Industrial Indian School<\/a> in Pennsylvania. The majority concluded that the <a href=\"https:\/\/www.nps.gov\/subjects\/nagpra\/index.htm\">Native American Graves Protection and Repatriation Act<\/a>, a federal law commonly known as NAGPRA, applies to remains at a cemetery   managed by the U.S. military.\r\n<P><\/P>\r\n&#8220;In the late 1800s, two children of the Winnebago Tribe of Nebraska were removed\r\nfrom their homes and placed in a federal Indian boarding school on a United States Army\r\nbase,&#8221; <a href=\"https:\/\/en.wikipedia.org\/wiki\/Pamela_Harris_(judge)\">Judge Pamela Harris<\/a> noted in the <a href=https:\/\/indianz.com\/News\/242081-majority\/>25-page majority decision<\/a>.  \r\n<p><\/p>\r\n&#8220;The boys died at the school, allegedly as a result of abusive conditions, and were\r\nburied on site without the consent of their families and in contravention of their tribal and\r\nreligious traditions,&#8221;   continued Harris, who was nominated to the federal bench over a decade ago by then-president Barack Obama.\r\n<P><\/p>\r\n<iframe loading=\"lazy\" src=\"https:\/\/www.facebook.com\/plugins\/post.php?href=https%3A%2F%2Fwww.facebook.com%2FWinnebagoTribeofNebraska%2Fposts%2Fpfbid02TxZfnV8xLeohxYNK8LCLgLtmADjG3y4S1y2KsZ628oRyDge5qbmTrT8ug3oF12Dwl&#038;show_text=true&#038;width=500\" width=\"500\" height=\"620\" style=\"border:none;overflow:hidden\" scrolling=\"no\" frameborder=\"0\" allowfullscreen=\"true\" allow=\"autoplay; clipboard-write; encrypted-media; picture-in-picture; web-share\"><\/iframe>\r\n<p><\/P>\r\nThe <a href=\"https:\/\/www.army.mil\/\">Department of the Army<\/a>, which oversees the <a href=\"https:\/\/armycemeteries.army.mil\/Cemeteries\/Carlisle-Barracks-Main-Post-Cemetery\">Carlisle Barracks Post Cemetery<\/a>, rejected the tribe&#8217;s request to return the remains of <a href=\"https:\/\/narf.org\/cases\/winnebago-carlisle-nagpra\/\">Samuel Gilbert and Edward Hensley<\/a> to Nebraska. But the appeals court said one of the primary purposes of NAGPRA is to correct &#8220;shameful&#8221; actions of the U.S. government. \r\n<P><\/p>\r\n&#8220;It does a disservice to the Congress that enacted NAGPRA to suggest that the act\u2019s purpose would be vindicated by leaving this tragic injustice unremedied,&#8221; the decision stated.\r\n<p><\/p>\r\n&#8220;On the contrary, it is the repatriation of Samuel\u2019s and Edward\u2019s remains so that they may be\r\nburied consistent with tribal tradition that would honor Congress\u2019s intent to address the\r\n&#8216;desires of Indians to bury their dead,&#8217; for too long &#8216;ignored,'&#8221; Harris wrote, quoting the words of the late U.S. Sen. <a href=https:\/\/en.wikipedia.org\/wiki\/Daniel_Inouye>Daniel Inouye<\/a>, a Democratic lawmaker who was the primary sponsor of NAGPRA more than 35 years ago.\r\n<p><\/p>\r\nYet even though NAGPRA went on the books decades ago in 1990, the 4th Circuit observed that the Winnebago case represents the first of its kind. No tribe &#8212; so far &#8212; has been able to force the U.S. military to comply with the law.\r\n<p><\/p>\r\nInstead, other tribes have had to follow arcane military regulations to reclaim young ones who died at Carlisle and were buried there. Photo: U.S. Office of Army Cemeteries<\/figcaption>\r\n<P><\/P>\r\n\u201cThe Fourth Circuit\u2019s ruling brings joy to the tribe,&#8221; <a href=https:\/\/indianz.com\/News\/2026\/05\/14\/press-release-winnebago-tribe-wins-decision-in-nagpra-case\/>Winnebago Chairman Coly Brown said in a news release<\/a> on Thursday. &#8220;As the court recognized, it would be a disservice to find NAGPRA does not protect the Winnebago\u2019s right to bring home Samuel Gilbert and Edward Hensley for proper burials, according to our traditional practices.&#8221;\r\n<p><\/p>\r\n&#8220;NAGPRA is an important statute our relatives fought for and is meant to &#8216;address the desires of Indians to bury their dead,&#8217; a right &#8216;for too long ignored,'&#8221; Brown added, again emphasizing the legislative history of the 1990 statute.\r\n<p><\/p>\r\nBut as is often the case with novel court actions, the view on NAGPRA is far from unanimous. The  tribe lost the initial round in the litigation when a federal judge in Virginia sided with the Army and agreed to dismiss the lawsuit.\r\n<P><\/p>\r\nAnd one member on the 4th Circuit thinks the majority got it wrong with Thursday&#8217;s ruling. <a href=\"https:\/\/en.wikipedia.org\/wiki\/Allison_Jones_Rushing\">Judge Allison Jones Rushing<\/a> &#8212; who was nominated to the federal bench by President Donald Trump  during his first term in office &#8212; issued a dissent stating that she too would have  dismissed the lawsuit.\r\n<p><\/p>\r\n&#8220;Edward and Samuel were buried on federal land before Congress passed NAGPRA and they remain buried there today,&#8221; Rushing wrote in the <a href=https:\/\/indianz.com\/News\/242081-dissent\/>16-page dissent<\/a> &#8212; nearly as long as the majority ruling. &#8220;Under NAGPRA, then, their graves are protected from excavation.&#8221;\r\n<P><\/p>\r\n&#8220;So how does the majority conclude that NAGPRA requires the Army to exhume their bodies?&#8221; Rushing continued. &#8220;It does so by interpreting &#8216;holdings or collections&#8217; to include all graveyards on federal land.&#8221;\r\n<p><p>\r\n&#8220;The statute\u2019s language and structure refute that interpretation,&#8221; the Republican-nominated judge asserted.\r\n<p><\/p>\r\n <a href=\"https:\/\/indianz.com\/News\/2024\/07\/16\/bring-our-kids-home-winnebago-tribe-in-court-over-children-buried-at-indian-boarding-school\/winnebagotribe\/\" rel=\"attachment wp-att-38486\"><img loading=\"lazy\" decoding=\"async\" width=\"2560\" height=\"1920\" data-attachment-id=\"38486\" data-permalink=\"https:\/\/indianz.com\/News\/2024\/07\/16\/bring-our-kids-home-winnebago-tribe-in-court-over-children-buried-at-indian-boarding-school\/winnebagotribe\/\" data-orig-file=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2024\/07\/16\/winnebagotribe.jpg\" data-orig-size=\"2560,1920\" data-comments-opened=\"0\" data-image-title=\"Winnebago Tribe\" data-image-description=\"&lt;p&gt;Winnebago Tribe&lt;\/p&gt;\n\" data-image-caption=\"&lt;p&gt;Representatives of the Winnebago Tribe, along with the Native American Rights Fund and Cultural Heritage Partners, pose outside of the federal courthouse in Alexandria, Virginia, on July 12, 2024. The tribe is represented in the case by the <a href=\"https:\/\/narf.org\/\">Native American Rights Fund<\/a> (NARF),  <a href=\"https:\/\/www.culturalheritagepartners.com\/\">Cultural Heritage Partners<\/a> and <a href=\"https:\/\/bigfirelaw.com\/\">Big Fire Law and Policy Group<\/a>.\r\n<p><\/p>\r\n\u201cWinnebago\u2019s lawsuit demonstrates its commitment to honor its ancestors and its children; and Winnebago continues to advocate for its rights under NAGPRA to bring Samuel and Edward home and provide them with the tribal burials they were denied over 125 years ago,&#8221; said  NARF Senior Staff attorney Beth Margaret Wright, <a href=https:\/\/soundcloud.com\/indianz\/sets\/winnebago-tribe-of-nebraska-v>who argued the appeal<\/a> last September. &#8220;The Fourth Circuit recognized that Congress enacted NAGPRA as a remedy for this \u2018shameful injustice.\u2019\u201d\r\n<P><\/p>\r\n\u201cThis is an extraordinarily important decision not only for the Winnebago Tribe, but for Tribal Nations across the country seeking to ensure that federal agencies finally comply with the laws enacted to help address the profound and multigenerational trauma inflicted by the federal Indian boarding school system,\u201d said Greg Werkheiser of Cultural Heritage Partners.\r\n<P><\/P>\r\n <a href=\"https:\/\/indianz.com\/News\/2024\/10\/25\/national-endowment-for-the-humanities-an-important-milestone-for-all-of-us\/carlisleindianindustrialboardingschool\/\" rel=\"attachment wp-att-42606\"><img loading=\"lazy\" decoding=\"async\" width=\"1336\" height=\"1002\" data-attachment-id=\"42606\" data-permalink=\"https:\/\/indianz.com\/News\/2024\/10\/25\/national-endowment-for-the-humanities-an-important-milestone-for-all-of-us\/carlisleindianindustrialboardingschool\/\" data-orig-file=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2024\/10\/28\/carlisleindianindustrialboardingschool.jpg\" data-orig-size=\"1336,1002\" data-comments-opened=\"0\" data-image-title=\"Carlisle Indian Industrial School\" data-image-description=\"&lt;p&gt;Carlisle Indian Industrial School&lt;\/p&gt;\n\" data-image-caption=\"&lt;p&gt;Indian students at the Carlisle Indian Industrial School in Carlisle, Pennsylvania, circa 1901. By the time it closed in 1918, more than 10,000 children from over 140 tribes were sent there as part of a federal policy aimed at disconnecting them from their nations and communities.\r\n<p><\/p>\r\nThe school&#8217;s infamous founder and longtime superintendent was <a href=https:\/\/en.wikipedia.org\/wiki\/Richard_Henry_Pratt>Richard Henry Pratt<\/a>, a  military general. In a speech just three years before Samuel and Edward were taken from  Winnebago, he explained why Indian children were being sent to Carlisle.\r\n<P><\/p>\r\nThe goal was simple, <a href=https:\/\/carlisleindian.dickinson.edu\/teach\/kill-indian-him-and-save-man-r-h-pratt-education-native-americans>Pratt said in 1892<\/a>: &#8220;Kill the Indian in him, and save the man.&#8221;\r\n<p><\/p>\r\nAccording to the <a href=https:\/\/carlisleindian.dickinson.edu\/>Carlisle Indian School Digital Resource Center<\/a>, a project of Dickinson College in Pennsylvania, <a href=https:\/\/carlisleindian.dickinson.edu\/student_files\/samuel-gilbert-student-information-card>Samuel Gilbert<\/a> died at Carlisle only a month after arriving in the fall of 1895. He was just 19 years old.\r\n<p><\/p>\r\n<a href=https:\/\/carlisleindian.dickinson.edu\/index.php\/student_files\/edward-hensley-student-information-card>Edward Hensley<\/a> also entered Carlisle in 1895, on the same day as his fellow Winnebago citizen. He died four years later, at the age of 17, according to school records.\r\n<p><\/p>\r\nBut as the 4th Circuit noted, there is no indication in the record that the families of Samuel and Edward were informed of their deaths and subsequent burials. The lack of consent was a frequent topic in the appeals court decision.\r\n<p><\/p>\r\n&#8220;Our decision today does not open the floodgates to disinterment of consensually\r\nburied Native Americans,&#8221; the 4th Circuit majority stated. &#8220;Nor does it require agencies or museums to find and inventory remains they never knew they possessed.&#8221;\r\n<p><\/p>\r\n&#8220;It holds only that Native American human remains purposefully held by a federal agency or federally funded museum without the requisite familial or tribal consent must be inventoried and, upon a qualifying descendant\u2019s or tribe\u2019s request, repatriated pursuant to NAGPRA,&#8221;
