Photo by Indianz.Com <a href=\"https:\/\/creativecommons.org\/licenses\/by-nc-sa\/4.0\/\">(CC BY-NC-SA 4.0)<\/a><\/figcaption>\r\n<div class=\"h3-responsive font-weight-bold\">Supreme Court accepts first Indian law case in new conservative era<\/div>\r\n<div class=\"date\">Monday, November 23, 2020<\/div>\r\n<div class=\"byline\">By Acee Agoyo<\/div>\r\n<div class=\"source\">Indianz.Com<\/div>\r\n<p><\/p>\r\nFor the second time in as many years, the <a href=https:\/\/www.supremecourt.gov\/>U.S. Supreme Court<\/a> will be taking up a case that impacts the treaty rights of the <a href=http:\/\/www.crow-nsn.gov\/>Crow Tribe<\/a>.\r\n<p><\/p>\r\nIn an order on Friday, the justices agreed to hear <a href=https:\/\/sct.narf.org\/caseindexes\/us_v_cooley.html><EM>United States v. Cooley<\/em><\/a>. The  case is the first Indian law dispute on the docket for the high court&#8217;s <a href=https:\/\/sct.narf.org\/termindexes\/october2020.html>current term, which began in October<\/a> amid a major ideological battle that brought <a href=https:\/\/indianz.com\/News\/2020\/10\/27\/cronkite-news-supreme-court-gains-conservative-majority-with-justice-amy-coney-barrett\/>another conservative member to the bench<\/a>.\r\n<p><\/p>\r\nBut <em>Cooley<\/em> won&#8217;t be the first time most of the justices have been called to examine the <a href=\"http:\/\/www.littlebighorn.info\/Articles\/crow68.htm\">1868 Treaty with the Crows<\/a>. Two years ago, the court determined that the <a href=https:\/\/indianz.com\/News\/2019\/05\/20\/supreme-court-backs-offreservation-treat.asp>tribe&#8217;s off-reservation hunting rights<\/a> have never been abrogated.\r\n<P><\/P>\r\nMindful of the outcome in <a href=https:\/\/sct.narf.org\/caseindexes\/herrera_v_wyoming.html><EM>Herrera v. Wyoming<\/em><\/a>,  which was decided in May 2019, the tribe is once again seeking for victory. A friend of the court brief reminds the justices that just a few short months ago, they forced the <a href=https:\/\/indianz.com\/News\/2020\/07\/09\/on-the-far-end-of-the-trail-of-tears-nat.asp>United States government to honor its trust and treaty responsibilities<\/a>.\r\n<P><\/P>\r\n\u201cThis court should &#8216;hold the government to its word,&#8217;\u201d attorneys for the <a href=https:\/\/sct.narf.org\/documents\/us_v_cooley\/amicus_crow_tribe.pdf>tribe  told the justices<\/a>, quoting from the historic ruling in <a href=\"https:\/\/sct.narf.org\/caseindexes\/mcgirt_v_ok.html\"><em>McGirt v. Oklahoma<\/em><\/a>, one of the most consequential Indian law cases in recent history.\r\n<P><\/P>\r\n<div class=\"embed-responsive embed-responsive-16by9\">\r\n<div class=\" content_cards_card content_cards_domain_youtu-be\">\n\t\t\t<div class=\"content_cards_image\">\n\t\t\t\t<a class=\"content_cards_image_link\" href=\"https:\/\/youtu.be\/3LimBWrWuBA\">\n\t\t\t\t\t<img decoding=\"async\" src=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2026\/06\/09\/maxresdefault-2453.jpg\" alt=\"17-30022 USA v. Joshua Cooley, No. 17-30022 &#8211; May 14, 2018<\/a>\r\n<\/figcaption>\r\n<P><\/p>\r\nUnlike the situation <em>McGirt<\/em>, however, in which the Trump administration repeatedly <a href=https:\/\/indianz.com\/News\/2018\/11\/27\/trump-administration-argues-against-trib.asp>disavowed its legal and moral obligations<\/a>, the Crow Tribe has the backing of the executive branch. In fact, it was the <a href=https:\/\/www.justice.gov\/>Department of Justice<\/a> that asked the Supreme Court to hear the new case, calling it a threat to the rights of Indian nations across the country.\r\n<P><\/P>\r\n\u201cRequiring tribes to give up even <em>more<\/em> of their limited sovereignty merely to preserve law and order within reservation boundaries is not an adequate solution,\u201d <a href=https:\/\/sct.narf.org\/documents\/us_v_cooley\/cert_petition.pdf>government attorneys wrote in their petition<\/a> to the high court.\r\n<P><\/P>\r\nThe dispute in  <em>Cooley<\/em> arises from a seemingly routine traffic stop that occurred on the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Crow_Indian_Reservation\">Crow Reservation in Montana<\/a> more than four years ago. According to the government&#8217;s brief, tribal police officer James Saylor encountered a vehicle whose driver exhibited increasingly erratic behavior.\r\n<P><\/P>\r\nSaylor eventually discovered methamphetamine and a firearm  in the car (along with a small child) and the driver was indicted in federal court on drug trafficking charges. But the case was thrown out because <a href=\"https:\/\/indianz.com\/News\/wp-content\/uploads\/2020\/11\/11111890857.pdf\">Joshua James Cooley<\/a> was able to have the evidence suppressed on the grounds that tribal law enforcement lack criminal jurisdiction over non-Indians.\r\n<P><\/P>\r\n\u201cSaylor never asked Cooley whether he was an Indian or otherwise ascertained that he was not. Instead, he reached a conclusion about Cooley\u2019s status as a non-Indian based on physical appearance alone,\u201d the <a href=https:\/\/www.ca9.uscourts.gov\/>9th Circuit Court of Appeals<\/a> wrote in a unanimous decision from March 2019. \u201cOfficers cannot presume for jurisdictional purposes that a person is a non-Indian \u2014 or an Indian \u2014 by making assumptions based on that person\u2019s physical appearance.\u201d\r\n<P><\/p>\r\n<figure>\r\n<img decoding=\"async\" itemprop=\"image\"  src=\"https:\/\/indianz.com\/News\/2017\/06\/27\/welcometocrowcountry.jpg\" class=\"img-fluid\"><\/img>\r\n<figcaption class=\"figure-caption\">A welcome sign on the Crow Reservation in Montana. In a brief to the Supreme Court, they argued that tribal treaty rights have never been part of the discussion until now.\r\n<P><\/P>\r\n\u201cThe government does not press the treaty right issue\u201d being raised by the tribe, <a href=https:\/\/sct.narf.org\/documents\/us_v_cooley\/cert_opposition.pdf>Cooley&#8217;s attorneys wrote<\/a>, adding: \u201cThat issue was not raised, let alone considered, in either of the lower courts.\u201d\r\n<P><\/P>\r\nWith their <a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2020\/11\/112020zr1_q861.pdf>order on Friday<\/a>, the justices did not explain why they agreed  to hear <em>Cooley<\/em>. They could have been swayed by the federal government&#8217;s presentation or by the tribal interest briefs, which included one signed by the <a href=https:\/\/www.niwrc.org\/>National Indigenous Women&#8217;s Resource Center<\/a> and five Indian nations, all of whom have been exercising jurisdiction over non-Indians in certain domestic violence matters.\r\n<p><\/p>\r\n\u201cForcing tribal law enforcement to wait to intervene until domestic violence becomes &#8216;obvious&#8217; or &#8216;apparent&#8217; will cost lives,\u201d reads the brief, which was joined by the Confederated Tribes of the Chehalis Reservation, the Confederated Tribes of the Umatilla Indian Reservation, the  Fort Peck Assiniboine and Sioux Tribes, the Pascua Yaqui Tribe and the Quinault Nation.\r\n<p><\/p>\r\n<div class=\"mt-1 mb-1\"><ins class=\"adsbygoogle\" style=\"display:block; text-align:center;\" data-ad-layout=\"in-article\" data-ad-format=\"fluid\" data-ad-client=\"ca-pub-8411603009680747\" data-ad-slot=\"6394965691\"><\/ins><script>(adsbygoogle = window.adsbygoogle || []).push({});<\/script><\/div><p><\/p>\r\nAlthough the 9th Circuit decision in <em>Cooley<\/em>  was unanimous, some strong disagreements surfaced after  the U.S. government asked the court to rehear the case by putting it before a larger set of judges. The Department of Justice&#8217;s petition for a rehearing <en>en banc<\/em> was rejected this past  January but  not everyone was on board with the development.\r\n<P><\/p>\r\nIn a dissent joined by three colleagues, <a href=https:\/\/en.wikipedia.org\/wiki\/Daniel_P._Collins>Judge Daniel P. Collins<\/a>  said the case posed \u201clife-or-death consequences for many of the hundreds of thousands of persons who live on Indian reservations located within this circuit.\u201d  The appeals court hears cases <a href=https:\/\/www.ca9.uscourts.gov\/content\/view.php?pk_id=0000000135>affecting tribes in seven Western states<\/a>, where some of the largest reservations in the country are located.\r\n<P><\/p>\r\n\u201cThe panel\u2019s extraordinary decision in this case directly contravenes long-established Ninth Circuit and Supreme Court precedent, disregards contrary authority from other state and federal appellate courts, and threatens to seriously undermine the ability of Indian tribes to ensure public safety for the hundreds of thousands of persons who live on reservations within the Ninth Circuit,\u201d   Collins wrote.\r\n<P><\/p>\r\nThe dissent  was    notable in several respects. At the time of the denial of the government&#8217;s <en>en banc<\/em>  petition  in January, Collins  had only been serving on the 9th Circuit for several months, having been nominated by outgoing  President Donald Trump, a Republican.\r\n<p><\/p>\r\nOf the three judges who joined Collins in calling for a rehearing, <a href=\"https:\/\/en.wikipedia.org\/wiki\/Mark_J._Bennett\">Mark J. Bennett<\/a> and <a href=\"https:\/\/en.wikipedia.org\/wiki\/Daniel_Aaron_Bress\">Daniel Aaron Bress<\/a>  were nominated to the 9th Circuit by Trump. The other was <a href=\"https:\/\/en.wikipedia.org\/wiki\/Carlos_Bea\">Carlos Bea<\/a>, who was  a pick of Republican president George W. Bush.\r\n<P><\/P>\r\nOn the other hand, the two 9th Circuit judges who explained why the case wasn&#8217;t worthy of another hearing were <a href=https:\/\/en.wikipedia.org\/wiki\/Marsha_S._Berzon>Marsha S. Berzon<\/a>, who was nominated to the bench by Democratic president Bill Clinton, and <a href=https:\/\/en.wikipedia.org\/wiki\/Andrew_D._Hurwitz>Andrew D. The forthcoming decision could provide guidance to judges across the nation in matters affecting law enforcement in Indian Country.\r\n<p><\/p>\r\n\u201cThe decision below precludes tribal officers from routine law-enforcement activities necessary to protect both the tribe and the public at large from dangerous and criminal activity within the boundaries of the tribe\u2019s reservation,\u201d <a href=https:\/\/sct.narf.org\/documents\/us_v_cooley\/cert_reply.pdf>government attorneys wrote in their reply brief<\/a>, which was submitted late last month, before the petition was granted by the Supreme court.\r\n<p><\/p>\r\nThe justices will now accept briefs as they consider the merits of <EM>United States v. Cooley<\/em>. A hearing has not been scheduled but it is expected to take place early 2021, as the court has already released its <a href=https:\/\/www.supremecourt.gov\/oral_arguments\/calendarsandlists.aspx>calendar through the end of this year<\/a>.\r\n<p><\/p>\r\nOral arguments have been taking place virtually, due to the <a href=\/covid19\/>COVID-19 pandemic<\/a>. Prior to <em>McGirt v. Oklahoma<\/em>, which was heard on May 11, the last Indian law case that was  heard in person was <EM>Herrera v. Wyoming<\/em>, back in January 2019.\r\n<p><\/p>\r\n<figure><img decoding=\"async\" itemprop=\"image\" src=\"https:\/\/indianz.com\/News\/2019\/05\/20\/clayvinherrera.jpg\" class=\"img-fluid wow fadeIn\"><\/img><\/a>\r\n<figcaption class=\"figure-caption\">  Clayvin Herrera, in white cap, is seen with members of his  family on the Crow Reservation in Montana. Photo: <a href=https:\/\/www.flickr.com\/photos\/usfwsmtnprairie\/29398565394\/>Ivy Allen \/ USFWS<\/a>\r\n<\/figcaption><\/figure>\r\n<p><\/p>\r\nIn <EM>Herrera<\/em>, the Supreme Court ruled in favor of the Crow Tribe&#8217;s treaty rights by a vote of 5 to 4. <a href=https:\/\/en.wikipedia.org\/wiki\/Neil_Gorsuch>Justice Neil Gorsuch<\/a>, whose <a href=https:\/\/indianz.com\/News\/2017\/02\/17\/tribes-find-common-ground-with-donald-tr.asp>experience in Indian law<\/a> is <a href=https:\/\/indianz.com\/News\/2017\/03\/20\/supreme-court-nominee-fares-well-in-revi.asp>unprecedented<\/a>,  joined his more liberal-leaning colleagues in siding with a Crow citizen who was cited by the state of Wyoming for hunting on treaty protected territory.\r\n<p><\/p>\r\nThe vote in <em>McGirt<\/em> also was 5 to 4. Gorsuch wrote the landmark majority opinion, which confirmed the existence of the reservation promised to the <a href=https:\/\/www.mcn-nsn.gov\/>Muscogee (Creek) Nation<\/a> by treaty.\r\n<p><\/p>\r\nThe  ideological  makeup of the Supreme Court, however, has been dramatically altered following the passing of <a href=https:\/\/en.wikipedia.org\/wiki\/Ruth_Bader_Ginsburg>Justice Ruth Bader Ginsburg<\/a> in September. She had been a part of the 5-member majority in <em>McGirt<\/em> and <EM>Herrera<\/em>.\r\n<p><\/p>\r\nThe addition of <a href=\"https:\/\/en.wikipedia.org\/wiki\/Amy_Coney_Barrett\">Justice Amy Coney Barrett<\/a> to the court threatens to undermine the pro-tribal victories by reducing the vote in treaty rights cases to just 4 members. He is also refusing to allow for an orderly transition of the executive branch to Biden and his incoming team.\r\n<P><\/P>\r\nIn his <a href=https:\/\/indianz.com\/News\/2020\/10\/08\/joe-biden-and-kamala-harris-release-plan-for-tribal-nations\/>Plan for Tribal Nations<\/a>, Biden has promised to \u201c[n]ominate judges who understand federal Indian law\u200b, respect tribal sovereignty, and will uphold both our treaties and the U.S. Constitution.\u201d\r\n<P><\/P>\r\nDepending on the timing of the argument in <em>Cooley<\/em>, the case might be presented by the outgoing Trump administration or the new Biden one.\r\n<p><\/p>\r\n<div class=\"h5-responsive sub\">9th Circuit Court of Appeals Decisions<\/div>\r\n<a href=https:\/\/indianz.com\/News\/wp-content\/uploads\/2020\/11\/17-30022.pdf>United States v.
