Having endured colonization, Native women and advocates are\r\nspeaking up to reclaim justice &#8212; one piece at a time.\r\n<P><\/P>\r\nFour out of five Native women and girls experience violence in their lifetime, half of them\r\nexperience sexual violence and in some counties they <a href=https:\/\/nij.ojp.gov\/topics\/articles\/violence-against-american-indian-and-alaska-native-women-and-men>face murder rates at ten times the national average<\/a>.  Despite these devastating statistics, Native women have found their voice and are asking for justice.\r\n<P><\/P>\r\n\u201cThese statistics demonstrate a lack of accountability,\u201d said CEO Lori Jump, StrongHearts\r\nNative Helpline. \u201cWhen court jurisdiction is shared between Tribal, state and federal\r\ngovernments, and access to justice relies upon race, type of crime and where it occurred &#8211;\r\nperpetrators often escape prosecution.\u201d\r\n<P><\/P>\r\n<blockquote class=\"twitter-tweet\"><p lang=\"en\" dir=\"ltr\">\ud83d\udce3This month for Domestic Violence Awareness Month we are hosting another community chat as we explore our theme of Breaking The Cycle Happens in Community.<br><br>Pre-register today at <a href=\"https:\/\/t.co\/0cPIwyrrVH\">https:\/\/t.co\/0cPIwyrrVH<\/a> <a href=\"https:\/\/t.co\/kbljXpc7wj\">pic.twitter.com\/kbljXpc7wj<\/a><\/p>&mdash; strongheartsdv (@strongheartsdv) <a href=\"https:\/\/twitter.com\/strongheartsdv\/status\/1842943097925194160?ref_src=twsrc%5Etfw\">October 6, 2024<\/a><\/blockquote> <script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script>\r\n<p><\/p>\r\nThe <a href=https:\/\/nij.ojp.gov\/topics\/articles\/violence-against-american-indian-and-alaska-native-women-and-men>National Institute of Justice painted a picture of perpetrators who victimize Native people<\/a> when a study revealed that a whopping 97 percent of women identified the perpetrator as non-Native. Similarly, 90 percent of men identified non-Natives as perpetrators. (Rosay, 2016).\r\n<P><\/P>\r\nSadly, one third of Native women and men identified the perpetrator as being Native &#8212; 35\r\npercent of female victims and 33 percent of male victims.\r\n<P><\/P>\r\nThese devastating statistics are in no small part due to antiquated laws and a complicated legal\r\nsystem with court jurisdiction hanging in the balance. At the core of the issue is a <a href=https:\/\/supreme.justia.com\/cases\/federal\/us\/435\/191\/>1978 Supreme Court ruling <EM>Oliphant vs Suquamish<\/em><\/a> that held Tribes do not have criminal jurisdiction over\r\nnon-Natives.\r\n<P><\/P>\r\n\u201cThe ruling established a form of non-Native immunity in the judicial system and essentially\r\ndenied Tribal people equal access to justice,\u201d Jump explained. \u201cThe ruling couldn\u2019t have been\r\nworse and for more than 35 years, Native women and girls have borne the impact of that tragic\r\ndecision.\u201d\r\n<P><\/P>\r\nAgainst the odds, Native women and their allies challenged Congress to restore some form of\r\nTribal court jurisdiction so that perpetrators could be held accountable. It was their tenacity and\r\ntestimony that inspired Congress to take action.\r\n<P><\/P>\r\nViolence Against Women Act (VAWA 2013) was reauthorized to included a historic provision\r\nthat recognized the inherent authority of \u201cparticipating Tribes\u201d to exercise \u201cspecial domestic\r\nviolence criminal jurisdiction\u201d (SDVCJ) over certain defendants, regardless of their Indian or non-Indian status, who commit acts of domestic violence or dating violence or <a href=https:\/\/www.justice.gov\/tribal\/2013-and-2022-reauthorizations-violence-against-women-act-vawa>violate certain protection orders in Indian country<\/a>.\r\n<P><\/P>\r\n\u201cSurvivors and advocates achieved what many thought impossible &#8212; to reclaim and restore a piece of Tribal sovereignty,\u201d Jump said.\r\n<P><\/P>\r\nIn 2022, VAWA (1994, 2005, 2013, 2022) Congress restored another piece of court jurisdiction\r\nwhen they amended a provision to recognize \u201cSpecial Tribal Criminal Jurisdiction\u201d (STCJ) over\r\nan expanded list of \u201ccovered crimes\u201d with additional provisions:\r\n<P><\/P>\r\n\u25cf Add Alaska Tribes to participating in the an STCJ Pilot Program,<BR>\r\n\u25cf Add formal authorization for the Tribal Access Program (TAP), and<BR>\r\n\u25cf Re-established the U.S. Bureau of Prisons (BOP) Tribal Prisoner Program.\r\n<P><\/P>\r\nStrongHearts Native Helpline applauds the work of survivors and advocates as their stories\r\ninspire Congress to continue its progression in the restoration of Tribal sovereignty.
